Alcohol and Wine Compliance Policy

Applies specifically to Danza del Sol Winery and Masia de la Vinya Winery, licensed California Type 02 Winegrower properties operating under the Kentina Hospitality Group.

1. Purpose and Scope

This Alcohol and Wine Compliance Policy establishes the legal and operational standards that govern all alcohol-related activities at Danza del Sol Winery and Masia de la Vinya Winery, both licensed California Type 02 Winegrower properties under the Kentina Hospitality Group.

This policy covers: tasting room service, direct-to-consumer (DTC) wine sales and shipments, wine club programs, on-site events, and any activity involving the service, sale, or distribution of alcoholic beverages at either winery property.

All staff, contractors, agents, and third-party vendors operating on behalf of either winery are required to comply with this policy in full.

2. Licensing

Danza del Sol Winery and Masia de la Vinya Winery each hold an active California Type 02 Winegrower License issued by the California Department of Alcoholic Beverage Control (ABC). All alcohol-related activities at both properties are conducted within the privileges and limitations of this license.

Any activity not expressly permitted under the Type 02 license, or under an applicable supplemental permit, must receive written approval from Kentina Hospitality management and, where required, from the California ABC before proceeding.

Type 93 Estate Tasting Event Permit

Effective January 1, 2026, the California ABC began accepting applications for the Type 93 Winegrower Estate Tasting Event Permit, which allows licensed Type 02 wineries to exercise tasting room privileges at estate vineyards and adjacent parcels not covered by the primary license. Each event under a Type 93 permit requires a separate ABC event authorization at a fee of $100 per event, with a maximum of 36 authorizations per winery per calendar year.

Important: If Danza del Sol Winery or Masia de la Vinya Winery intends to host tastings or events at any location outside their licensed bonded premises, a Type 93 permit and individual event authorization must be obtained before the event. Contact Kentina Hospitality management and ABC-licensed counsel before proceeding.

3. Age Verification

No alcoholic beverage may be served, sold, or provided to any person under 21 years of age. Both wineries enforce a strict age verification policy at all points of contact where alcohol is involved, including:

  • Tasting room service
  • Online wine purchases and DTC shipments
  • Wine club enrollment and shipment pickup
  • Private and public events where alcohol is served
  • Will-call wine pickup

On-Site Age Verification

All tasting room staff must request valid government-issued photo identification from any guest who appears to be under 30 years of age. Acceptable forms of ID include:

  • State-issued driver’s license or identification card
  • U.S. passport or passport card
  • U.S. military identification card
  • Tribal identification card issued by a federally recognized tribe

Expired identification is not acceptable. If a guest cannot produce valid identification, service must be refused. Refusal of service for lack of valid ID is not subject to exception under any circumstance, including for guests at private events.

Online Age Verification

All online wine sales through danzadelsolwinery.com and masiadelavinya.com require age verification at the point of purchase. Buyers must confirm they are 21 years of age or older via an affirmative age gate before accessing purchase functionality. Third-party age verification tools may be employed at checkout to validate date of birth against available records.

DTC Shipment Age Verification

All wine shipped directly to consumers requires an adult signature (21+) at delivery. Common carriers are instructed not to release wine shipments without a signature from an adult who can present valid government-issued photo identification. Shipments are labeled as required by California ABC: “CONTAINS ALCOHOL: SIGNATURE OF PERSON AGE 21 YEARS OR OLDER REQUIRED FOR DELIVERY.”

4. Responsible Beverage Service (RBS)

California AB 1221, effective July 1, 2022, requires all alcohol servers and managers at ABC on-premises licensees, including winery tasting rooms, to complete state-approved Responsible Beverage Service training and certification.

Kentina Hospitality compliance standards for both wineries:

  • All staff members over the age of 21 who serve alcohol at Danza del Sol Winery or Masia de la Vinya Winery are required to hold a current California ABC-approved RBS certification
  • New staff have 60 days from the date of initial employment to obtain RBS certification
  • RBS certification is valid for three years. All staff must complete recertification before their certification expires. The initial wave of 2022 certifications became due for renewal in 2025
  • Managers are responsible for maintaining a current roster of certified staff and tracking renewal dates
  • Documentation of RBS certifications must be retained and made available to the ABC upon request

Important: As of 2025, California ABC RBS certifications issued in 2022 have entered their first renewal cycle. Managers at both wineries must audit current certification status and initiate renewals for any staff whose certificates are within 90 days of expiration.

Responsible Service Standards

All tasting room staff are expected to apply responsible service principles at all times, including:

  • Monitoring guest alcohol consumption throughout a visit
  • Refusing service to any guest who is visibly intoxicated, regardless of how much or how little they have consumed on-site
  • Offering water and food alternatives to guests showing signs of intoxication
  • Contacting management if a guest disputes a refusal of service
  • Not permitting any guest to leave the property in a condition that poses a risk to themselves or others

Neither winery may offer or permit any promotion, game, or activity that encourages rapid or excessive alcohol consumption.

5. Direct-to-Consumer (DTC) Wine Shipping Compliance

Both Danza del Sol Winery and Masia de la Vinya Winery hold applicable California DTC shipping privileges under their Type 02 licenses. All DTC activity must comply with the following:

Authorized States

Wine may only be shipped to states where DTC shipments from California wineries are currently authorized. The restricted state list (states to which direct shipment is not permitted) includes Alabama, Arkansas, Delaware, Kentucky, Massachusetts, Mississippi, Montana, Oklahoma, Pennsylvania, Rhode Island, South Dakota, and Utah. This list is subject to change as state laws evolve. Both wineries must verify current authorization status before processing orders to any state not previously shipped to.

Carrier Compliance

All DTC wine shipments must use a licensed common carrier that complies with ABC adult signature requirements. FedEx Ground is the preferred carrier for both wineries. Carriers must be instructed to:

  • Require adult signature (21+) with government-issued photo ID at delivery
  • Not release packages to persons who cannot produce valid ID
  • Return undeliverable shipments to the originating winery

Shipment Records

Both wineries must maintain adequate DTC shipment records as required by California ABC and the federal Alcohol and Tobacco Tax and Trade Bureau (TTB). Records must include buyer information, shipment date, carrier, destination state, and quantity shipped. Records must be retained for a minimum of three years and made available to the ABC or TTB upon request.

Title Transfer

All wine sold by Danza del Sol Winery and Masia de la Vinya Winery is sold in California. Title passes to the buyer in California at the point of carrier pickup. The buyer assumes all risk of loss after carrier pickup, except where wine is confirmed defective upon arrival.

6. Tasting Room Policies

The following policies apply to tasting room operations at both wineries:

  • Service animals only are permitted inside tasting rooms and covered patios. Well-behaved leashed dogs may be permitted on open patios at Masia de la Vinya; check current posted policy
  • Outside food and beverage policies vary by property and day of week. Staff must follow current posted policies and communicate them clearly to guests
  • Groups of eight or more guests must make a reservation in advance. Transportation companies must be on the Temecula Valley Wine Growers Association (TVWGA) RPP-approved carrier list to operate in wine country
  • All equestrian guests at Danza del Sol Winery must call in advance to make a reservation to stage. Owners are responsible for their horses. All equestrian rules posted on-site must be followed
  • No beverages, tents, shade covers, large ice chests, or excessive outside decor are permitted on winery patios or in tasting rooms

7. Events and Private Functions

Events held at Danza del Sol Winery or Masia de la Vinya Winery where alcohol is served must comply with all California ABC license conditions applicable to the Type 02 license, and with any conditions specific to supplemental permits in effect for the event.

For any event at a location outside the bonded winery premises, a Type 93 Estate Tasting Event Permit authorization must be obtained before the event date. See Section 2 for details.

Event coordinators are responsible for ensuring:

  • All serving staff at events are RBS-certified
  • Age verification is conducted at entry or at point of service for all events where alcohol is served
  • A sober event captain or manager is designated and on-site for the duration of all events where alcohol is served
  • Last call and service cutoff procedures are followed
  • Transportation options are available or communicated to guests

8. Wine Club Compliance

Wine club operations at both wineries must comply with:

  • 21+ age requirement for all members at enrollment and renewal
  • DTC shipping compliance for all shipped club orders (see Section 5)
  • Accurate member records maintained per ABC and TTB requirements
  • Wine club wine is for member personal consumption only and may not be resold without appropriate licensure
  • Early cancellation fees and billing terms must be clearly disclosed at enrollment and honored as stated

9. Bottle Labeling Compliance

All wine produced and sold by Danza del Sol Winery and Masia de la Vinya Winery must carry the following mandatory label elements:

  • Federal Surgeon General health warning (TTB requirement)
  • Contains Sulfites disclosure, where applicable
  • Net contents (750ML or applicable volume)
  • Producer identification and address
  • CA CRV California Redemption Value marking, as required by the California Beverage Container Recycling and Litter Reduction Act (Bottle Bill) and AB 720 (signed October 2025). Mandatory compliance on all new production by July 1, 2026
  • DTC shipment containers must be conspicuously labeled: “CONTAINS ALCOHOL: SIGNATURE OF PERSON AGE 21 YEARS OR OLDER REQUIRED FOR DELIVERY”

Important: Any new label designs or revisions to existing labels must be submitted to the TTB for a new Certificate of Label Approval (COLA) before use. Do not produce wine with unlabeled or unapproved labels.

10. Compliance Violations and Reporting

Any staff member who witnesses or becomes aware of a potential compliance violation, including service to a minor, service to a visibly intoxicated guest, unauthorized activity outside license privileges, or shipment to a prohibited state, must report the violation to their manager immediately.

Managers must escalate all potential ABC violations to Kentina Hospitality management promptly. Do not attempt to resolve potential ABC violations without management and legal involvement.

Kentina Hospitality management is responsible for reporting any ABC violations or license conditions as required by law and for cooperating fully with any ABC inspection or investigation.
