1. Agreement to These Terms

These Terms and Conditions govern your access to and use of kentinahospitality.com, together with any content, features, or communications offered through it. The website is operated by Kentina Business Holdings, LLC, referred to in these Terms as Kentina Hospitality, we, us, or our.

By accessing or using this website, you agree to be bound by these Terms. If you do not agree to them, please do not use the website.

We may update these Terms at any time. Changes take effect when posted, and the Last Updated date above will be revised. Your continued use of the website after a change is posted constitutes acceptance of the revised Terms.

2. What This Website Is

kentinahospitality.com is an informational website. It provides information about the Kentina Hospitality properties and directs visitors to the individual property websites.

No reservations, bookings, purchases, memberships, or payments are made through this website. All transactions are completed on an individual property website or through a third-party booking or payment platform.

Kentina Hospitality operates the following properties in Temecula Valley, California:

• Danza del Sol, a winery, tasting room, wine club, and event venue on the De Portola Wine Trail
• Masia de la Vinya, a boutique winery, tasting room, wine club, and event venue on the De Portola Wine Trail
• Galway Downs, a 240-acre equestrian center, event venue, and lodging property
• Native Falls Campground, a campground with cabin lodging and outdoor recreation
• Cross Creek Golf Club, a golf course and event venue

Property descriptions, offerings, hours, programming, and pricing are subject to change without notice.

3. Property Websites and Their Terms

Each Kentina Hospitality property operates its own website. Where a property publishes its own terms, those terms govern your transaction when you book, reserve, purchase, or enroll on that website, including all deposit, payment, cancellation, refund, rescheduling, shipping, and membership terms. Where a property does not publish its own terms, Section 3.1 applies.

These Terms govern your use of kentinahospitality.com only. They do not govern transactions completed elsewhere.

Private events, weddings, equestrian bookings, and group functions are governed by a separate written agreement with the applicable property. Where a signed event agreement conflicts with any website terms, the signed agreement controls.

3.1 Properties That Do Not Publish Separate Terms

Galway Downs and Cross Creek Golf Club do not currently publish separate website terms. For bookings and visits at those properties, these Terms apply together with the provisions below and with any separate written agreement you sign with the property.

Bookings made under a written agreement

Weddings, private events, group functions, equestrian bookings, and golf tournaments are arranged under a separate written agreement with the property. That agreement sets deposit, payment, minimum spend, cancellation, and rescheduling terms, and it controls where it conflicts with these Terms.

Tee times and daily play

Tee time reservations, greens fees, cart policies, dress code, and pace of play rules are set by Cross Creek Golf Club and are available from the property. Cancellation and no-show terms for tee times are those disclosed to you at the time of booking.

Equestrian and outdoor activities

Equestrian activities carry an inherent risk of injury. Participants, handlers, and spectators are responsible for their own conduct, for following all posted safety rules and the direction of property staff, and take part at their own risk. Owners remain responsible for their animals at all times.

Information about these properties published on our websites is provided for reference and is subject to change without notice. Contact the property directly to confirm current availability, pricing, and terms.

4. Eligibility

You must be at least 18 years of age and legally capable of entering into a binding contract to use this website.

Some Kentina Hospitality properties offer alcoholic beverages, wine sales, and wine club memberships. Those services are restricted to individuals 21 years of age or older, and age verification is required at the point of purchase, at delivery, and at check-in for any reservation or event at which alcohol is served. Those requirements are administered by the applicable property under its own terms and under California law.

5. Acceptable Use

You agree to use this website lawfully and not to:

• Use the website for any unlawful purpose or in violation of these Terms
• Interfere with, disable, or circumvent any security feature of the website
• Attempt to gain unauthorized access to any system, account, or data
• Upload or transmit malicious code, spam, or harmful material
• Misrepresent your identity or age
• Use automated systems to scrape, harvest, or copy website content without prior written consent

We may restrict or terminate your access to this website for any violation of these Terms.

6. Conduct on Property

Visitors to any Kentina Hospitality property are responsible for their own conduct and for the conduct of their party, and must follow all posted rules and safety requirements at that property, including equestrian safety requirements at Galway Downs. Each property reserves the right to remove any guest engaging in disruptive, unsafe, or unlawful behavior.

7. Intellectual Property

All content on this website, including text, graphics, logos, images, photography, video, wine label artwork, software, and design elements, is owned by Kentina Hospitality, the applicable property, or their licensors, and is protected by United States and international intellectual property laws.

You may not copy, reproduce, distribute, modify, publicly display, or create derivative works from any website content without prior written consent, except that you may view, download, and print pages for your own personal, non-commercial use.

8. Third-Party Websites and Services

This website links to and integrates third-party websites and services, including the property websites, booking platforms, mapping tools, and social media platforms. We do not control and are not responsible for the content, terms, privacy practices, availability, or performance of any third-party website or service.

Following a link away from this website is at your own risk and subject to the terms and privacy policy of the destination site.

9. Communications

If you provide an email address or phone number through this website, you consent to receive communications related to your inquiry and, where you have opted in, marketing communications.

Text message communications are governed by the Kentina Hospitality SMS Terms and Conditions. Message frequency varies, and message and data rates may apply. You may opt out of text messages at any time by replying STOP. Mobile carriers are not liable for delayed or undelivered messages.

Your information is handled in accordance with the Kentina Hospitality Privacy Policy and the Cookie and Tracking Disclosure.

We make reasonable efforts to keep website information current, but do not warrant that content is complete, accurate, or up to date. Property offerings, hours, pricing, availability, and programming change, and the applicable property website is the authoritative source for its own current information.

To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of information. To the fullest extent permitted by law, Kentina Hospitality and its owners, officers, employees, contractors, and affiliates shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to your use of this website, including damages arising from website errors, omissions, interruptions, delays, or from any third-party website or service linked from it.

Our total aggregate liability arising from your use of this website shall not exceed one hundred dollars (100.00 USD). Some jurisdictions do not permit certain limitations of liability, and in those jurisdictions liability is limited to the maximum extent permitted by law.

Liability arising from a reservation, purchase, event, or visit to a property is governed by the terms of the applicable property and any signed agreement, not by these Terms.

13. Indemnification

You agree to indemnify, defend, and hold harmless Kentina Hospitality and its owners, officers, employees, contractors, and affiliates from any claims, damages, liabilities, costs, or expenses, including reasonable attorneys’ fees, arising from your violation of these Terms, your misuse of this website, or your negligence or misconduct.

14. Force Majeure

We are not liable for any delay or failure to perform resulting from circumstances beyond our reasonable control, including natural disasters, wildfire, extreme weather affecting the Temecula Valley, government-mandated closures, public health emergencies, utility or network failures, labor disputes, or acts of God.

15. Dispute Resolution

Any dispute arising out of or relating to these Terms or your use of this website shall first be addressed through good-faith negotiation. If the dispute is not resolved within thirty (30) days, it shall be submitted to binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, seated in Riverside County, California. Each party bears its own attorneys’ fees unless otherwise required by law.

To the extent permitted by law, disputes shall be resolved on an individual basis, and you and Kentina Hospitality each waive any right to bring or participate in a class, collective, or representative action.

Nothing in this section limits your right to file a complaint with a regulatory agency, including the California Department of Alcoholic Beverage Control or the California Privacy Protection Agency.

16. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions.

17. Severability

If any provision of these Terms is found invalid or unenforceable, that provision shall be limited or removed to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with the Kentina Hospitality Privacy Policy, Cookie and Tracking Disclosure, SMS Terms and Conditions, and Accessibility Statement, constitute the entire agreement between you and Kentina Hospitality regarding your use of this website.
